Buy new and you pay for extra crap like freight, stock fee, fluids fee, just standing there fee, etc. etc.

gator skin boots, just standing there fee...haha you guys r funny. Jokes aside, I think I'm gona go for it. He will have to come to Austin for paperworks so I plan to inspect the bike for anything undesirable. Hopefully this will be smooth and a great buy because you guys can't imagine how badly I want to ride one soon.

I found another Phantom in the Dallas area, had my friend check it out and he took pics of what he found was wrong with the bike. This bike has less than $500 miles and is asking under $6000, comes with saddle bags and a helmet only. Do I need to worry about the small damage on the second pic?

You're moaning about 8k miles? Jeeze he did the break in for you. That is still like a new bike!
FWIW I wouldn't pay 6k for a used 750 or a new one for that matter. There are tons of early 2k's for under 4 with only slightly more mileage. Hell around here you can snag bikes with 8-20k on them for under 3500 quite often.

That bike in Dallas I would think would be negotiable. Even though the damage is superficial, potential buyers have a lot of angst when it comes to "dropped" bikes. I'm sure you could use this as negotiation leverage.
I don't think you are getting ripped off at 6K but there are plenty of people who buy that bike for the looks and have displacement regret shortly after. These are the ppl that would give you a screaming deal on a Phantom. I guess I fell into that category with my black 2009 Spirit 750 (< 3500 mi). Here is what I parted with for 3800. Probably could have gotten +4000 but I sold in the off-season and wanted the money to buy a new bike without payments.

I understand the "I need more power' thing but I am getting a 750 for sure and won't ever be moving up to a more powerful one. And I have my eyes set at the Phantom so my hunt is taking some time. Talked to the seller, he won't budge. aaahhh
