(I'm not an attorney, nor do I play one on television. Just a paralegal, several eons ago.)

I'd get an estimate, see if she wants to cover it. If not, small claims, for all it's hassles, is better than crawling uphill with an insurance company. Tho to be fair, State Farm covered 90% of my vandalism damage with no fuss.

Guess I'm just a different kind of person, but small claims seems a bit harsh. Sounds like the damage was minimal and fault was on both parties. Like Gat said...we bear the responsibility of expecting the worst of any vehicle near our path of travel. I would find prices for replacement parts and guess how long it's gonna take to fix and add $30 per hour for he repairs(be fair). Then I would ask the neighbor if they will cover all/part of it and do the work myself. If they won't, heck, that's life. Fix your ride and move on....lesson learned. Glad your ok and can ride another day.

Similar type of accident happened to me last week. I got away with quite a bit of road rash unfortunately (I laid the bike on its side then I fell off halfway through the slide, tumbling down the road going about 45 mph).

very similar damage - left turn signals (Front and back), gear pedal pushed into the camshaft cover (pierced it and drained the oil out), speedometer, back of the mirror scuffed up/side of the headlight scuffed up.

Unfortunately for me, the person who turned into my path of travel is long gone, and most likely didn't even realized they had caused an accident/crash (I don't like the term accident).

I plan on wearing a pair of sunglasses with a built in camera from now on. If I was wearing one at the time I crashed last week, I would have the person's license plate and some kind of case against them.

I wish you best of luck on repairing your bike, and I agree with a few other posters: practicing swerving and emergency stopping seems to be the most proactive response to preventing this situation again (laying the bike down, there will always be stupid drivers). I plan on taking another safety course after I repair my bike.

As far as insurance goes - I have allstate (they seemed to have the best customer service when I was shopping around for insurance, much more personable) and gave me the cheapest quote for the most coverage. I called my agent and let her know what happened, she got my tow covered - and apparently the doctor I visit also billed them as well as my health insurance, so I didn't have to pay a copay (yay) to get patched up.

Nice to hear that you didn't sustain any bad injuries.
As far as liability is concerned I don't think you'll get anything from her or her insurance company. I had a situation once in my car where a passenger in my car was opening a door and a person outside the car kicked the door closed....causing a dent. I called the cops..Person outside the car told the cops that the door was going to hit him and he was protecting himself...Cop said "You should have let it hit you...but you hit it...therefore you're responsible". So going by what the cop said in my situation I'd have to think you'd have to have had contact with her car in order for her to pay anything.

Amazing that you came out more or less intact. Kudos for your luck.

Sucks but it's better to leave a dent on the other car than it is to avoid it. There's absolutely no telling what kind or even if injury will occur in any motorcycle accident, but if your going down, make sure it's because you HIT the other vehicle. Insurance and police use damage as their primary evidence. No damage = no fault.

Same goes for deer and other animals.

I would have reported it. One can never tell how much the little things will add up.
Hit by a school bus last year, over 1700 worth of damage despite all but sitting still.
Hideous bruise on my leg I was concerned about (which is still tender and brown) when in all actuality, I had a tear in my left bicep muscle (if girls have biceps that is, LOL!), and two new protrusions in my neck. Lovely.

Since I first read this I had to make a run to the grocery store. I backed out of my driveway. I don't know how I could have done this without displaying brake lights. While starting, putting the car in gear, any hesitation before backing into the road I hit the brakes. I have to think the driver in the car used their brakes. I think you missed them.
